Maejousz Club Terms & Conditions

These Terms & Conditions govern your use of the Maejouzs Loyalty App, our website, and all services offered through the Platform. Please read them carefully before registering an account or using any feature of the Platform.

By downloading the application, creating an account, or using any feature of the Platform, you agree to be fully and legally bound by this Agreement in its entirety. If you do not agree, you must immediately cease all use of the Platform.

Section 01

Eligibility & Account Registration

1.1 Minimum Age Requirement

The Platform and all services offered therein are strictly intended for individuals who are eighteen (18) years of age or above. The Maejouzs venue is a licensed nightclub operating in Malaysia, and all on-premises activities are subject to statutory minimum age restrictions. By registering, you expressly represent and warrant that you are at least 18 years of age.

1.2 Registration Requirements

To access the full suite of features, you must complete the account registration process and provide accurate information, including:

1.3 Account Security & Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials. You agree to:

Each individual is permitted to maintain only one (1) active membership account. The Company reserves the right to merge, suspend, or permanently delete duplicate accounts without prior notice.

1.5 OTP Verification

Following registration, a One-Time Password (OTP) will be sent to your registered email or phone number. Account activation will only occur upon successful OTP validation.

Digital Membership Card & QR Code System

Upon successful account creation and OTP verification, a digital membership card is generated displaying your name, current tier, dynamic QR code, loyalty points balance, visit count, and Member ID.

2.1 QR Code Usage & Restrictions

Your dynamic QR code is unique to your account. You must not:

Any attempt to manipulate or misuse the QR code system may result in immediate account suspension, permanent blacklisting, and/or denial of entry.

2.2 Entry Validation at the Venue

Club entry via QR scan is subject to automated checks including member identity verification, blacklist status, age verification, and VIP/Platinum tier status.

Platform Access & Acceptable Use

Subject to your compliance with this Agreement, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Platform for your personal, non-commercial purposes.

You agree that you will not use the Platform, directly or indirectly, to:

Events & RSVP

The Platform provides a monthly event calendar with dot-highlighted event dates. Event detail pages display the DJ lineup, event time, location, ticket pricing, and RSVP links. All event information is subject to change.

Event Tickets

VIP Early Access

Platinum VIP Members receive early access to event RSVPs and ticket purchases prior to general release, subject to tier status and availability.

Section 05

Payment Terms

All financial transactions on the Platform — including table deposits, bottle packages, event tickets, and pre-ordered drinks — are processed through a PCI-DSS compliant third-party payment gateway. The Company does not store full payment card details.

Third-Party Services & Integrations

The Platform integrates with the following categories of third-party services:

Your use of such services is subject to their respective terms and privacy policies, which are independent of this Agreement.

Section 07

Push Notifications & Marketing Communications

7.1 Notification Categories

You may customise delivery via the Settings module using All Notifications, Event Alerts, and Reward Alerts toggles. Certain SYSTEM notifications (e.g. security alerts) may be delivered regardless of preference settings.

Section 08

Intellectual Property

All content, software, application design, graphics, trademarks, logos, and data forming part of the Platform are the exclusive property of the Company or its licensors and are protected by applicable Malaysian and international intellectual property laws, including the Trade Marks Act 2019 and Copyright Act 1987.

You may not reproduce, copy, distribute, adapt, modify, or commercially exploit any part of the Platform's intellectual property without our express prior written consent.

Section 09

Data Retention Policy

9.1 Active Account Data

Personal data associated with an active account — including profile, visit records, loyalty history, booking records, and bottle parking records — is retained for the full duration of your active account.

9.2 Retention Schedule After Deletion

9.3 Inactive Account Policy

Accounts inactive for a continuous period of 24 months may be subject to archiving or deletion, with advance notice to the registered email.

Refund & Booking Policy

Where we cancel or materially modify an event or reservation, we will offer either (a) a rescheduled booking at a mutually agreed alternative date, or (b) a credit voucher equivalent to the deposit amount.

10.4 Event Ticket Refunds

Tickets are non-refundable except where the event is wholly cancelled by the Company with no alternative offered, or a verified technical error resulted in a duplicate purchase. Refund requests must be submitted within 7 calendar days.

10.5 Refund Processing

Approved refunds are processed through the original payment method, typically within 14–21 business days of approval.

Loyalty Points & Rewards Policy

11.3 Rewards Catalogue & Redemption

Members may redeem points for welcome drinks, club merchandise, table upgrades, and entry passes. Redeemed rewards are final and cannot be converted back to points or cash.

11.4 Points Expiry & Non-Transferability

Points are personal to the Member's account, are not transferable, have no cash value, and are subject to an expiry policy as configured by the Club Admin. Reminders are issued via push notification before expiry.

Referral Programme Policy

Upon registration, each Member is automatically assigned a unique alphanumeric referral code displayed on the profile and referral screens. The programme operates as follows:

Bottle Parking & Expiry Policy

The bottle parking service enables Members to store unfinished alcohol bottles at the venue for future redemption. The four-step parking workflow is:

Twenty-One (21) Day Expiry

All parked bottles expire 21 calendar days from the date of confirmed parking. Bottles not redeemed within this window are permanently forfeited, with no refund or compensation.

Volume Accuracy & Storage

The Member is solely responsible for accurately recording the remaining volume. The Company exercises reasonable care in physical storage but accepts no liability for natural deterioration over time.

Section 14

User Conduct & Club Entry Policy

14.1 Prohibited Conduct

The following conduct is strictly prohibited and may result in denial of entry, removal, account suspension, permanent blacklisting, or referral to the authorities:

14.2 Right to Refuse Entry

The Company and its authorised staff retain the absolute right to refuse entry to or remove from the venue any person whose conduct, state, or circumstances pose a risk to safety or operations — regardless of membership tier. No refunds will be provided where denial of entry is attributable to the Member's own conduct.

14.3 Blacklist Policy

Flagged accounts will be denied entry upon QR scan. Members who believe they have been incorrectly blacklisted may submit a written appeal to our support email. The Company will review all appeals within 14 business days; our decision is final.

14.4 Age Verification

Staff reserve the right to require presentation of a valid physical ID (MyKad, passport, or equivalent). Any Member found or reasonably suspected to be under 18 will be refused entry, and their account terminated.

Section 15

Disclaimer & Limitation of Liability

The Platform and all services are provided on an "as is" and "as available" basis, without warranty of any kind. To the fullest extent permitted by Malaysian law, we disclaim all warranties, whether express, implied, or statutory.

15.1 No Liability For

15.2 Aggregate Liability Cap

Where liability cannot be fully excluded by law, our total aggregate liability arising out of this Agreement or your use of the Platform shall not exceed the total amount paid by you to the Company during the six (6) calendar months immediately preceding the event giving rise to the claim.

15.3 Member Indemnity

You agree to indemnify and hold harmless the Company from any claims arising out of your use of the Platform, your breach of this Agreement, your violation of applicable law, or your conduct at the venue.

Section 16

Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Malaysia. Applicable legislation includes, without limitation, the Personal Data Protection Act 2010, Consumer Protection Act 1999, Communications and Multimedia Act 1998, Contracts Act 1950, Sale of Goods Act 1957, Electronic Commerce Act 2006, Copyright Act 1987, Trade Marks Act 2019, and Mediation Act 2012.

Consumer Statutory Rights

Nothing in this Agreement limits any statutory rights you may have under the Consumer Protection Act 1999 or any other applicable Malaysian consumer protection law.

Section 18

General Provisions

18.1 Entire Agreement

This Agreement, together with the Privacy Policy and all referenced policies, constitutes the entire agreement between you and the Company.

18.2 Severability

If any provision is held invalid or unenforceable, it shall be severed to the minimum extent necessary, and the remaining provisions continue in full force and effect.

18.3 Language

This Agreement is written in English. In the event of inconsistency with any translation, the English version shall prevail.

18.4 Amendments

We reserve the right to amend this Agreement at any time. Material changes will be notified via SYSTEM-type push notification and/or in-app notice. Continued use of the Platform after amendment constitutes your acceptance of the revised Agreement.
